1. Agreement to Terms
These Terms of Service (“Terms”) constitute a binding legal agreement between you and Modern Hockey League (“MHL,” “we,” “us,” or “our”) governing your access to and use of the website at modernhockeyleague.com (the “Site”), the MHL-Bot, official MHL Discord servers, and all related league services (collectively, the “Services”).
BY ACCESSING OR USING THE SERVICES, YOU REPRESENT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR Privacy Policy AND Cookie Policy, EACH INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICES.
2. Eligibility
You must be at least thirteen (13) years of age, or the minimum age required by Discord, Electronic Arts, Xbox, PlayStation, and your jurisdiction, whichever is greater, to use the Services. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You represent that you have the legal capacity to enter into this agreement and that your participation does not violate any applicable law, league ban, or platform sanction.
3. Description of Services
MHL operates an organized online hockey league using EA SPORTS NHL on Xbox Series X|S and PlayStation 5 crossplay. The Services include league administration through the Site and MHL-Bot, including signups, rosters, schedules, stats, standings, waivers, and communications. Season 1 is a pilot season; features, schedules, and systems may change with notice.
MHL may modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, to the fullest extent permitted by law.
4. League Rules
Participation in MHL is subject to all official MHL rulebooks, guides, and staff decisions, including the Regular Season & Game Night Rulebook (Version 1.0, as updated from time to time), and any supplemental documents referenced therein. Those documents are incorporated into these Terms by reference.
MHL Staff may interpret, enforce, amend, or waive league rules during the pilot season where necessary to preserve fairness, operability of the bot or Site, or league integrity. Staff decisions regarding league play, discipline, stats, forfeits, and reschedules are binding unless overturned by MHL leadership.
Failure to comply with league rules constitutes a material breach of these Terms and may result in suspension or removal from the league.
5. Accounts and Registration
You agree to provide accurate, current, and complete information when registering or participating, including your correct gamer tag or online ID, Discord identity, and team affiliation. You are responsible for maintaining the confidentiality of any credentials and for all activity under your account.
You may not impersonate another person, use another player’s account, permit another person to use your account for league games, or create duplicate accounts to evade discipline or roster rules.
6. Prohibited Conduct
You agree not to:
- Cheat, exploit glitches, use banned builds or traits, or otherwise gain unfair advantage;
- Harass, threaten, or direct hate speech or personal attacks at players, managers, or staff;
- Submit false complaints, falsify evidence, or mislead MHL Staff;
- Interfere with the Site, bot, or Discord infrastructure, including unauthorized scraping or attacks;
- Collect Personal Information of other users without authorization;
- Use the Services for unlawful purposes or in violation of third-party terms;
- Circumvent suspensions, bans, or roster restrictions.
Violations may be addressed under the MHL Discipline & Complaints Rulebook and may result in warnings, game penalties, forfeits, suspensions, or permanent removal.
7. Third-Party Platforms
THE SERVICES INTEGRATE WITH OR DEPEND ON THIRD-PARTY PLATFORMS, INCLUDING DISCORD, MICROSOFT (XBOX), SONY (PLAYSTATION), AND ELECTRONIC ARTS. MHL IS NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY EA, DISCORD, MICROSOFT, OR SONY. YOUR USE OF THOSE PLATFORMS IS GOVERNED SOLELY BY THEIR TERMS AND POLICIES.
MHL IS NOT RESPONSIBLE FOR SERVER OUTAGES, NETWORK FAILURES, GAME PATCHES, ACCOUNT SANCTIONS, OR OTHER ACTS OR OMISSIONS OF THIRD PARTIES. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THIRD-PARTY SERVICES.
8. Intellectual Property
The Site, MHL branding, logos, rulebooks, and original content are owned by Modern Hockey League or its licensors and are protected by intellectual property laws. EA, NHL, and related marks are property of their respective owners.
You receive a limited, non-exclusive, non-transferable, revocable license to access the Services for personal league participation. You may not copy, modify, distribute, or create derivative works from MHL content without prior written consent.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MHL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
NO ADVICE OR INFORMATION OBTAINED THROUGH THE SERVICES CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MHL, ITS OPERATORS, STAFF, VOLUNTEERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF MHL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MHL’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100.00) OR THE AMOUNT YOU PAID TO MHL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to defend, indemnify, and hold harmless Modern Hockey League, its operators, staff, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms or league rules; (c) your violation of any third-party right; or (d) any content or proof you submit.
12. Suspension and Termination
MHL may suspend or terminate your access to the Services, remove you from rosters, or impose league discipline at any time, with or without notice, for any violation of these Terms, league rules, or conduct detrimental to the league. Upon termination, provisions that by their nature should survive will survive, including Sections 7–11 and 13–15.
13. Governing Law and Disputes
13.1 Canada
If you are resident in Canada, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You irrevocably attorn to the exclusive jurisdiction of the courts located in Ontario, Canada, except where mandatory consumer protection laws of your province provide otherwise.
13.2 United States
If you are resident in the United States, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except that the FAA governs arbitration where applicable. Subject to Section 13.4, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
13.3 International
If you are resident outside Canada and the United States, these Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Ontario, except where local law mandates non-waivable consumer protections or jurisdiction.
13.4 Informal resolution and arbitration
Before initiating formal proceedings, you agree to contact legal@modernhockeyleague.com and attempt in good faith to resolve the dispute for thirty (30) days. If unresolved, either party may elect binding arbitration administered by a recognized arbitration provider in Ontario or Delaware, as applicable to your residence, except that either party may seek injunctive relief in court for intellectual property or unauthorized access.
13.5 Class action waiver
TO THE EXTENT PERMITTED BY LAW, YOU AND MHL EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. DISPUTES MUST BE BROUGHT INDIVIDUALLY.
14. Changes to Terms
We may revise these Terms at any time by posting an updated version on the Site with a revised “Last updated” date and, where material, notice through official MHL Discord channels. Your continued use after the effective date constitutes acceptance. If you do not agree, you must cease use of the Services.
15. General Provisions
Entire agreement. These Terms, the Privacy Policy, Cookie Policy, and incorporated rulebooks constitute the entire agreement regarding the Services.
Severability. If any provision is held invalid, the remaining provisions remain in effect.
No waiver. Failure to enforce any provision is not a waiver of future enforcement.
Assignment. You may not assign these Terms without MHL’s consent. MHL may assign these Terms in connection with a transfer of operations.
Force majeure. MHL is not liable for delays or failures due to events beyond reasonable control, including platform outages, acts of God, or governmental action.
